Photo and Video Release

This is a sample of the photo and video release that members may be asked to sign in person. Signature is voluntary and not required for membership. You can choose to sign, skip, or sign with restrictions on which uses you authorize.

Plain-Language Summary

This is a document that gives Able Years permission to take photos or videos of you in classes, and to use them in our marketing materials.

Five things to know:

  1. Signing this is optional.Whether you sign or not has no effect on your membership, your classes, or anything else. You don't have to sign to be a member.
  2. You choose what we can use. You can check yes for some things (e.g., website, social media) and no for others (e.g., paid advertising). Each use type is its own checkbox.
  3. You can change your mind.You can revoke this release at any time, and we'll stop using your image in new materials.
  4. No compensation.We don't pay for member photos or testimonials. If we ever do (or give you anything of value), we'll disclose that publicly per FTC rules.
  5. Your name.We use first name only (e.g., “Sue M.”) unless you specifically ask us to use your full name. You can also ask for no name at all.

1. Parties

This Photo, Video, and Likeness Release is between:

  • Able Years LLC, a Washington limited liability company (UBI 606 140 951), located in Spokane, Washington.
  • You, the member or prospective member identified by signature.

2. Grant of Permission

You grant Able Years a non-exclusive, royalty-free, perpetual (subject to revocation per Section 6), worldwide right to:

  • Photograph you (still images).
  • Record video of you (with or without audio).
  • Record audio of you (separately or as part of a video).
  • Edit, crop, retouch, color-correct, and otherwise process the images, video, and audio.
  • Publish, display, and distribute the resulting materials in the use cases you authorize in Section 3.

This grant covers materials captured at:

  • The Able Years studio (Spokane, WA).
  • Off-site classes, demonstrations, or events organized or attended by Able Years.
  • Strategy Sessions, when explicitly initiated by you.

3. Authorized Uses (Each Use Is a Separate Checkbox on the Signed Form)

This Release is granular. You may authorize some uses and not others. Each box must be individually checked on the signed form to authorize the corresponding use. Unchecked boxes are unauthorized.

  1. Able Years' website — blog posts, member-story pages, About page, similar marketing pages.
  2. Social media (organic posts) — non-paid posts on Able Years' accounts (Facebook, Instagram, YouTube, LinkedIn, TikTok, and similar).
  3. Email and SMS marketing — email newsletters, marketing automation sequences sent by Able Years.
  4. Print marketing materials — physical brochures, flyers, posters, business cards.
  5. Paid advertising (digital) — paid social-media ads, display ads, similar paid digital placements.
  6. Paid advertising (print and broadcast) — paid newspaper, magazine, radio, television, billboard, or similar paid traditional-media placements.
  7. Founding Wall (physical display in studio) — a recognition wall or display inside the Able Years studio.
  8. Internal training materials — shown only to Able Years coaches and staff (not publicly distributed).
  9. Press, media, and journalist requests — materials Able Years provides to journalists or other media for stories about Able Years.
  10. Conferences and presentations — slides or videos shown by Able Years staff at fitness-industry or community conferences.

4. Use of Your Name

You will choose one of three options on the signed form:

  • 4.A. First name only (e.g., “Sue M.” or “Sue”).
  • 4.B. Full first and last name (e.g., “Sue Miller”).
  • 4.C. No name. Use a generic identifier (e.g., “a Founding Member”).

If no box is checked, the default is 4.A (first name only).

5. No Compensation

Able Years is not payingyou for this Release, the photos or videos taken of you, or any testimonial you provide. You are not entitled to royalties, residuals, or any other compensation for Able Years' use of your image, voice, or likeness in the authorized uses above.

If Able Years ever does provide compensation or anything else of value (including free or discounted classes, branded merchandise, or referral credit) in exchange for a testimonial, photo, or video, that fact will be disclosed publicly in connection with the materials, in accordance with the FTC Endorsement Guides (16 C.F.R. Part 255).

6. Right to Revoke

You may revoke this Release at any time by sending written notice to Able Years:

  • Email: nick@ableyears.com with subject line “Photo Release Revocation”
  • Mail: Spokane, Washington (specific address available upon request — studio location to be confirmed)
  • Hand delivery at the studio

Upon receipt of your revocation, Able Years will:

  • Within 30 days, stop using your image, voice, or likeness in any new materials.
  • Within 30 days, remove your image from Able Years' website, social media accounts (organic posts), and email/SMS marketing automation sequences.
  • Where practical, discontinue using existing print materials with your image. Able Years is not obligated to recall print materials already distributed but will not reorder or republish them with your image.

You acknowledge that Able Years cannot un-distribute materials already published (print runs already in members' homes, ads already aired, journalists' archives, etc.). The 30-day commitment applies to materials Able Years controls.

7. Testimonials and FTC Endorsement Guides Compliance

If you provide a written or recorded testimonial as part of this Release:

  • Able Years will not edit your testimonial in a way that materially changes its meaning.
  • Able Years will identify you accurately (per Section 4 above).
  • Able Years will not represent your experience as typical of all Able Years members. The Medical Disclaimer makes this explicit (“individual results vary”).
  • If you are a paid endorser, this fact will be disclosed in proximity to the testimonial.

8. Family Members or Other People in the Photo

If a photo or video Able Years takes of you also includes:

  • A family member or guest of yours: Able Years will not publish material in any way that identifies the family member by name or close-up image without that family member's separate consent.
  • Another member of Able Years: that member's separate Release applies to the same material; Able Years will publish only what is jointly authorized.
  • An Able Years coach or staff member: covered by Able Years' employment or contractor agreement with that staff member.

9. No Obligation to Use

Nothing in this Release obligates Able Years to use any particular photo, video, or testimonial. Able Years has full editorial discretion over what is published.

10. Choice of Law and Disputes

This Release is governed by the laws of the State of Washington. Any dispute arising from this Release is resolved as provided in Section 14 of the Terms of Service.

11. Acknowledgment

By signing the Release, you confirm that:

  • You are at least 18 years of age and have legal capacity to enter into this Release.
  • You have read this Release, including the use-case checkboxes and the name-use options.
  • You have had a fair opportunity to ask questions before signing.
  • You understand that signing is optional and that not signing has no effect on your membership.
  • You understand that you may revoke this Release at any time.
