Refund and Cancellation Policy

This policy is compliant with the Washington Health Studio Services Act (RCW 19.142) and the Washington Automatic Renewal Act (RCW 19.395).
Plain-Language Summary
- Three days. Within three business days after you sign a membership agreement, you can cancel for any reason and get all your money back. This is your right under Washington law.
- Month-to-month thereafter. After the three-day window, your membership is month-to-month. You can cancel at any time. After we receive your written cancellation, you'll be billed for the current month and not the next one.
- Refund timing. If we owe you a refund, we'll send it within 30 days, to the same payment method you used.
- Strategy Session fee. The $49 or $149 Strategy Session fee is non-refundable if you don't enroll. If you enroll, the fee becomes credit toward your first month.
- 90-Day Promise. If your Independence Score doesn't improve in your first 90 days, you can request a refund of monthly fees. There are conditions (you must attend at least 75% of classes and complete a 90-day reassessment).
- Medical hardship. If a medical event prevents you from training, we'll pause your billing — no charge — for as long as needed.
- Cancellation method. Email, mail, or hand delivery — your choice.
1. Scope
This Policy applies to:
- The Strategy Session (a paid intake, health screening, and movement assessment).
- Membership (monthly recurring services).
- Founding Member terms (the first 40 enrolled members).
It does not apply to merchandise, retail purchases, or third-party-provided services.
2. Three-Day Right to Cancel (RCW 19.142.030)
NOTICE: YOUR THREE-DAY RIGHT TO CANCEL UNDER WASHINGTON LAW
You have the right to cancel any membership agreement you sign with Able Years for any reason within three (3) business days after the day you sign.
If you cancel within three business days, Able Years will refund all amounts you paid in connection with the agreement, including the Strategy Session fee if you ask us to refund it.
To cancel, you must deliver a written cancellation notice to Able Years within the three-business-day period. You may deliver the notice by:
- Email to nick@ableyears.com.
- U.S. mail to: Able Years LLC, Spokane, Washington (specific address available upon request — studio location to be confirmed).
- Hand delivery at our studio (an Able Years staff member will initial and date your copy as confirmation of receipt).
The notice does not need to be in any specific form. A simple statement that you wish to cancel — with your name, the date, and a way to contact you — is enough.
A “business day” is any day other than Saturday, Sunday, or a Washington State or federal holiday. The three-day period begins the day after you sign the agreement.
We will process your refund within 30 days of receiving your cancellation notice, to the original payment method.
3. Strategy Session Cancellation and Refund
The Strategy Session is a paid, scheduled appointment that includes intake paperwork, health screening (PAR-Q+), a movement assessment, and a programming consultation.
3.1 Pricing
- Founding Member rate: $49 (first 40 enrollees only).
- Standard rate: $149.
3.2 Refund treatment
- If you cancel and do not enroll as a member: the Strategy Session fee is non-refundable, except as required by Section 2 (Three-Day Right to Cancel).
- If you enroll as a member: the Strategy Session fee is applied as a credit to your first month's membership fee.
3.3 Rescheduling
You may reschedule a Strategy Session up to 24 hours before the scheduled time without forfeiting the fee. Reschedules requested less than 24 hours before may be honored at our discretion.
3.4 No-show
If you do not arrive for a scheduled Strategy Session and do not give us notice, the fee is forfeited. We will offer one rescheduling courtesy on a case-by-case basis.
4. Membership Cancellation
After the three-day cancellation period in Section 2 has passed, your membership is month-to-month.
4.1 How to cancel
You may cancel your membership at any time by providing a written cancellation notice:
- Email to nick@ableyears.com.
- U.S. mail to: Able Years LLC, Spokane, Washington (specific address available upon request — studio location to be confirmed).
- Hand delivery at our studio.
We recommend keeping a copy.
4.2 When cancellation takes effect
Your cancellation is effective at the end of your current billing cycle. You will continue to have access to scheduled classes through the end of that cycle. You will not be charged for the next billing cycle.
4.3 Refund of unused prepaid fees
We do not collect more than the current month's fees in advance, so there is typically nothing to refund at cancellation. If for any reason you have prepaid for unused class days, we will issue a pro-rated refund within 30 days, to the original payment method.
5. Founding Member Terms
5.1 Rate protection
Founding Members (the first 40 enrolled members) receive month-to-month membership with rate protection: Able Years intends not to raise the Founding Member rate ($219 for 2x/week or $309 for 3x/week) for these founding members for the duration of their continuous membership. Founding Members remain free to cancel month-to-month at any time after the three-day cancellation period in Section 2.
In other words: this rate protection is a benefit you receive, not an obligation you take on. You can leave any time.
5.2 If a Founding Member cancels
If you cancel as a Founding Member, the Founding Member rate ends with your cancellation. If you later re-enroll:
- Within 90 days of your cancellation: you may re-enroll at your prior Founding Member rate.
- More than 90 days after cancellation: you may re-enroll at then-current standard pricing.
5.3 No early-termination fee
There is no early-termination fee for Founding Members or any other member. Cancellation is free of charge.
6. Auto-Renewal Disclosure (RCW 19.395)
NOTICE: AUTOMATIC RENEWAL OF YOUR MEMBERSHIP
Your membership renews automatically every month.
Each month, on the same day of the month as your enrollment date, Able Years will charge the payment method on file the monthly membership fee ($219, $249, $309, or $349 depending on your plan). The charge will continue every month until you cancel.
You can cancel at any time. See Section 4 for how. After we receive your cancellation, you will not be charged for the next billing cycle.
For Founding Members: The first week of classes is free. We will start your monthly billing automatically at the end of your first week. You can cancel any time during the free week and you will not be charged.
If we later need to change pricing, we will notify you at least 30 days before the change takes effect, and you can cancel at no charge before the change applies.
7. The 90-Day Promise
If your Independence Score does not improve within the first 90 days of your membership, you may request a refund of all monthly membership fees paid during that 90-day period.
7.1 Conditions
The refund is subject to these conditions:
- (a) 75% attendance. You must have attended at least 75% of your scheduled classes during the 90-day period. For 2x/week members: at least 18 of 24 classes. For 3x/week members: at least 27 of 36 classes. Classes Able Years cancelled, and classes missed during a medical hold, do not count against you.
- (b) Both assessments completed. Your Independence Score is measured both at enrollment and at the 90-day reassessment using Able Years' standard protocol. If you decline or do not attend the 90-day reassessment, the 90-Day Promise does not apply.
- (c) Written request within 14 days. You must submit your refund request in writing within 14 days of your 90-day reassessment.
7.2 What's refunded
- Yes: Monthly membership fees paid during the 90-day period.
- No: Strategy Session fee. (You received the Strategy Session.)
- No: Any add-ons or merchandise.
- No: Fees paid before or after the 90-day period.
7.3 Refund processing
Approved 90-Day Promise refunds are issued within 30 days of approval, to the original payment method.
8. Medical Hardship
8.1 Medical hold (preferred for short-term)
We will pause your billing at no charge for as long as needed. There is no limit on the duration or number of medical holds. To place a medical hold, notify Able Years by phone, email, or text. We will pause billing immediately. To resume, contact us to schedule a return session. Depending on the nature of the medical event, we may request updated physician clearance before you return to classes.
8.2 Medical hardship cancellation (for permanent or long-term)
If your medical situation makes a return to training unlikely, you may cancel under medical hardship and receive a pro-rated refund of any prepaid fees. We may request a brief written confirmation from your physician that your physician is recommending against further training; we accept email or fax from the physician's office.
9. Trial Cancellation (Founding Member Free First Week)
Founding Members receive the first week of classes at no cost following enrollment.
9.1 Cancelling during the free week
You may cancel at any time during the free week, by any means listed in Section 4.1. You will not be charged for the next billing cycle. The $49 Founding Member Strategy Session fee is non-refundable unless you cancelled within the three-day window in Section 2.
9.2 Conversion to paid membership
If you do not cancel during the free week, your monthly billing will start automatically at the end of the free week, at the Founding Member rate ($219 or $309 depending on plan).
10. RCW 19.142.040 Bonding Analysis
RCW 19.142.040 requires a Washington health studio to obtain a bond or maintain a trust account if it collects more than three months of fees in advance.
Able Years does not collect more than the current month's fees in advance. Membership is billed monthly. Founding Members receive a free first week, then are billed monthly for the current month.
We do not currently offer:
- Annual prepayment discounts.
- Multi-month prepayment plans.
- Quarterly billing.
No bonding or trust account is therefore required at this time. If we later add any multi-month prepayment option, we will obtain the required bond or trust before doing so.
11. Chargebacks and Disputes
If you believe Able Years has charged you in error, please contact us first at nick@ableyears.com or (509) 309-0946. Most disputes can be resolved within a few business days. We commit to investigating and responding within 5 business days of receiving your dispute.
If you initiate a chargeback through your payment processor or credit card issuer, we may dispute the chargeback if we believe the charge was correct. A chargeback initiated for a charge that was correctly billed under your active membership is not a substitute for cancellation under Section 4.
12. Service Suspension or Termination by Able Years
We reserve the right to suspend or terminate your membership for:
- Non-payment after 14 days from a failed billing attempt.
- Material breach of the Terms of Service, the Liability Waiver, or this Policy.
- Conduct on the premises that endangers other members, staff, or the studio.
- Provision of materially false health information.
If we terminate your membership for cause, we will issue a pro-rated refund of any prepaid unused fees within 30 days.
13. Closure or Relocation by Able Years
If Able Years closes, relocates, or substantially changes its services in a way that materially affects you:
- We will provide at least 30 days' notice by email and, where applicable, in-class.
- During any period of closure, your billing is paused.
- If you cancel because of the closure, we will refund any prepaid unused fees within 30 days.
